Sir,

With reference to the letter of the 29th August,

1922, from His Honour Mr. Justice Peter Grain, on the subject

of the transhipment at Hongkong of persons deported by His

Britannic Majesty's Supreme Court for Chine, I have the honour to enclose a copy of a bill which has been drafted in order to give the Governor of Hongkong power to require the master of any British ship to accept the deportes as a passenger for the

purposes of the deportation.

2. You will notice that the bill assumes the making

of the new consolidating China Order in Council which is in

contemplation.

3. Though the obligation which the bill proposes to create will be imposed only within the jurisdiction of the Colony action under the bill would in fact have a continuing effect outside the jurisdiction. As this is so I propose to submit the draft bill to the Secretary of State for the Colonies for his approval before introduction. I shall be much obliged for any observations which Your Honour may wish to make on the bill, and I shall not address the Secretary of

State until I have received your reply.
